Read and sign our artist agreement

    1. Scheduling

    2. a. Artist will schedule a recording session at Studio through correspondence with a Studio representative. These correspondences can be through phone calls, text messages, Facebook messages, Instagram messages, or emails. b. Artist agrees to pay for studio time at the rate in effect at the time of booking. A nonrefundable deposit of one hundred dollars ($100.00) is required to confirm first-time bookings. Deposits for future bookings may not be required based on previous payment history. c. Artist and a Studio representative may discuss different time and date options for a new session, but a recording session is not scheduled until the Studio representative gets a confirmation from the Artist that the time and date agreed upon works for both parties and a one hundred dollars ($100) deposit has been received. d. Minimum session for first-time booking is three (3) hours. e. Rates are subject to change without notice.

    3. Arrival

    4. a. The address to arrive at is… 301 Melba Avenue Childersburg, AL 35044 b. The entrance to the studio is on the right side of the house, to the right of the garage. c. Parking is on the right side of the driveway on the grass; on the left side of the driveway on the grass; and on the street. d. WARNING! There is a deep drainage ditch on each side of the driveway entrance. Be cautious when entering and exiting the property. Studio and the property owner are not responsible for any damages. e. It is recommended to arrive a few minutes before your scheduled session starts. Be aware that there could be another session happening before yours. f. If a Nashburg representative is not there to open the door at your scheduled session time, please ring the doorbell at your scheduled session time.

    5. Time/Billing

    6. a. Billed time starts when the scheduled session time begins and ends when the artist exits the studio facility. b. Recording times and stop/restart times (for meal breaks) are rounded to the nearest half-hour. c. Studio time includes setup time, break down time, and any breaks taken by the artist(s) or engineer. The engineer will be allowed a break of up to 15 minutes every 2 hours to alleviate ear fatigue. All such time is billed time. d. The engineer will be allowed one 30-minute meal break per session and an additional meal break for sessions lasting longer than eight (8) hours. Meal breaks are NOT billed time.

    7. Payment

    8. a. The Studio shall not release complete recording files or copies thereof to the Artist or Artist’s representative until all monies due to the Studio have been paid. b. If not paid within 30 days of invoice date, the Artist’s recording files left on premises shall become the property of Studio. c. The Artist must pay a 10% late fee on the total cost of the invoice if any amount of the balance is paid past 30 days. d. Upon complete payment of all monies due by Artist, the Studio will transfer all recordings and ownership of sound recording copyrights to the Artist. All songwriting copyrights will remain with the author of the work.

    9. Cancellation

    10. a. If the artist has to cancel the scheduled recording session, a Nashburg representative needs to be notified at least 48 hours prior to the start of the scheduled time to avoid any cancellation fees. b. If the artist fails to notify a Nashburg representative of a cancellation 48 hours prior to the session, the Artist will be charged two (2) recording hours. c. If Nashburg Recording Studio has to cancel the session within 48 hours of the scheduled start time, the Artist will be given two (2) free recording hours.

    11. Facilities

    12. a. Artist releases the Studio from any harm or damage that may occur to any person in the Artist’s party or to equipment belonging to the Artist. b. Artist shall be responsible for any loss or damage to Studio property incurred by Artist, employees of Artist, guests of Artist, or agents of Artist, as a result of misuse, negligence, and or carelessness. c. The Artist shall abide by the Studio Rules (which are a part of this agreement). Disobedience of these rules by the Artist or a guest of the Artist will be grounds for removal of said person or persons from the property, immediate termination of this agreement, and loss of future use of the studio. In the event of termination of this agreement due to such causes, there will be no refund of monies paid by the Artist. The Studio or its representative will have sole right to make such a determination. d. The Studio shall endeavor to secure all property left on premises by Artist, but is not responsible for loss due to theft, fire, acts of God, or other occurrences beyond its control.

    13. Final Product

    14. a. The Artist agrees to allow its name, photographic image, and/or musical samples to be used on the Studio’s website and/or for other promotional purposes. The Studio will not sell or allow downloads of the Artist’s music without prior agreement. b. Artist shall be responsible for obtaining all mechanical licenses for music for which the Artist does not own the rights. All such licenses must be obtained prior to duplication or replication. It is advantageous to assign ISRC codes for each recorded track, which should be embedded in the digital media when the master is produced. The Artist shall be responsible for and shall pay the fees for obtaining such codes.

    15. Studio Rules

    16. a. Smoking and Vaping - No smoking or vaping is allowed in the studio. You may smoke outside at least 10 feet away from the building. Please do not leave butts or matches on the ground. b. Illegal Substances - No illegal substances are allowed on the property. Any Artist or guest of the Artist found to be intoxicated or under the influence of any illegal substance or exhibiting any behavior deemed unprofessional by the Studio or its representative will be grounds for removal of said person or persons from the property and immediate termination of this agreement and loss of future use of the studio. In the event of termination of this agreement due to such causes, there will be no refund of monies paid by the Artist. The Studio or its representative will make the final judgment in such situations. c. Food and Drink – Food and non-alcoholic drinks are allowed in the studio. Any spills that cause damage to the building or equipment will be to be billed to the Artist. d. Trash - Please help us keep the area neat and orderly. Do not leave food or trash around the grounds or in the studio. Please clean up any mess that you make. Place all trash in appropriate containers. Place aluminum cans and bottles in the recycle bin.

    17. Family Friendly

    18. a. Nashburg Recording Studio is proud to be a family friendly studio. We encourage friends and family of the Artist to take part in the recording process. b. The Studio reserves the right to refuse recording any audio material deemed explicit by a Studio representative. c. Explicit content can include but is not limited to:
        i. Promoting illegal activities ii. Crude or profane language iii. References to violence, physical, or mental abuse iv. References to sexualized behavior v. Discriminatory language
